Beat My Squad

Beat My Squad is the New Emerging brand Limited Liability Partnership. Beat My Squad, offers cricket based, online fantasy contest. Beat My Squad as used herein shall be construed as a collective reference to Beat My Squad App on Android Version.

If you access the Service for making deposits or playing Contest from a jurisdiction where Contest are not permitted, you shall be entirely liable for any legal or penal consequences and we shall be entitled to forfeit the balance in your account.

You understand that the Terms will be binding on you. You agree that Services offered on the Portal can be accessed only in accordance with the Terms and you shall be responsible to comply with the Terms at all times. You are responsible to be aware of and agree to abide by the Terms as published and periodically amended or modified by Beat My Squad Fantasy Sports LLP.

If any of the Terms are determined to be unlawful, invalid, void or unenforceable for any reason by any judicial or quasi - judicial body in India, it will not affect the validity and enforceability of the remaining Terms. Our failure or delay to act or exercise any right or remedy with respect to a breach of any of the Terms by you shall not be construed as a waiver of our right to act with respect to the said breach or any prior, concurrent, subsequent or similar breaches. If a promotion, contest, event, competition or tournament is organized by us on a Portal, it shall be governed by the Terms and any supplementary terms and conditions which may be specifically applied for that promotion, contest, event, competition or tournament.

Links to the following sections of these Terms are provided below for easy access to the sections you intend to refer to. However, you should read all Terms as you will be bound by them all. Click on any of the following link to access that section directly.

You may only use the Services to Play Cash Contest (as defined below) if you are 18 years of age or over. Access to our Services or any part thereof may be restricted by us from time to time in our sole decision. You confirm that you are not accessing the Services to play Cash Contest from Aasam, Odisa, Telangana, Nagaland or Sikkim.

We charge service charges for Cash Contest, which may vary depending on the nature of the Cash Contest and are subject to change from time to time. Non-Cash Contest is offered free on the Portal, but may be subject to entry restrictions in some cases. Service charges charged by us are inclusive of all applicable taxes, including GST.

User Representations

Any information provided by you to us, whether at the stage of registration or during anytime subsequently, should be complete and truthful.
Prior to adding cash to your user account or participating in Cash Contest, you shall be responsible to satisfy yourself about the legality of playing Cash Contest in the jurisdiction from where you are accessing Cash Contest. If you are not legally competent to individually enter into Indian Rupee transactions through banking channels in India and/or are not accessing any Website from a permitted jurisdiction, you are prohibited from participating in Cash Contest on the website. In the event of such violation, your participation in Cash Contest will be deemed to be in breach of the Terms and you will not be entitled to receive any prize that you might win in such Cash Contest.

You represent that you are 18 years of age or older to participate in any Contest and are also otherwise competent to enter into transactions with other users and us. You are aware that participation in the Contest organized by us ("Activity") may result in financial loss to you. With full knowledge of the facts and circumstances surrounding this Activity, you are voluntarily participating in the Activity and assume all responsibility for and risk resulting from your participation, including all risk of financial loss. You agree to indemnify and hold us, our employees, directors, officers, and agents harmless with respect to any and all claims and costs associated with your participation in the Activity.

You represent that you have the experience and the requisite skills required to participate in the Activity and that you are not aware of any physical or mental condition that would impair your capability to fully participate in the Activity. You further acknowledge that you are solely responsible for any consequence resulting from you participating in this Activity or being associated with this Activity or around this Activity. You understand that we assume no liability or responsibility for any financial loss that you may sustain as a result of participation in the Activity.

You understand and accept that your participation in a Contest available on the Portal does not create any obligation on us to give you a prize. Your winning of a prize is entirely dependent on your skill as a Beat My Squad vis-a- vis other Beat My Squads in the Contest and subject to the rules of the Contest.

You understand and agree that you are solely responsible for all content posted, transmitted, uploaded or otherwise made available on the Portal by you. All content posted by you must be legally owned by or licensed to you. By publishing any content on the Website, you agree to grant us a royalty-free, world-wide, non- exclusive, perpetual and assignable right to use, copy, reproduce, modify, adapt, publish, edit, translate, create derivative works from, transmit, distribute, publicly display, and publicly perform your content and to use such content in any related marketing materials produced by us or our affiliates. Such content may include, without limitation, your name, username, location, messages, gender or pictures. You also understand that you do not obtain any rights, legal or equitable, in any material incorporating your content. You further agree and acknowledge that we have the right to use in any manner whatsoever, all communication or feedback provided by you.

You understand and accept that we reserve the right to record any and all user content produced by way of but not limited to chat messages on the Portal through our feature, through the in-contest chat facility or other interactive features, if any, offered as part of the Services.

You understand that the funds in your user account held by us do not carry any interest or return.

You shall not hold us responsible for not being able to play any Contest for which you may be eligible to participate. This includes but is not limited to situations where you are unable to log into your user account as your user account may be pending validation or you may be suspected or established violation of any of the Terms.

You understand and accept that by viewing or using the Portal or availing of any Services, or using communication features on the Portal, you may be exposed to content posted by other users which you may find offensive, objectionable or indecent. You may bring such content posted by other users to our notice that you may find offensive, objectionable or indecent and we reserve the right to act upon it as we may deem fit. The decision taken by us on this regard shall be final and binding on you.

We are in compliance with FATF guidelines and therefore you are also required to comply with the FATF guidelines. By using our Portal, you undertake to comply with the FATF guidelines.
·         You represent that you are not a politically exposed person.
·         You represent that you have not been convicted for any crime.
·         You represent that you are not on the UN Sanctions List or work for a company that is on the UN Sanctions list.

User Account Creation & Operation

To use our Services, you will need to register with us on the Portal. By completing the online registration process on the Portal, you confirm your acceptance of the Terms. By registering on our Portal, you agree to receive promotional messages relating to Tournaments & Bonus through SMS, Email and Push Notifications. You may withdraw your consent by sending an email to support@Beat My Squad.com as the case may be.

During the registration process, you will be required to choose a login name and a password in addition to providing some other information which may not be mandatory. Additionally, you may be required to give further personal information for your user account verification and/or for adding cash to your user account. You must give us the correct details in all fields requiring your personal information, including, without limitation, your name, postal address, email address, telephone number(s) etc. You undertake that you will update this information and keep it current.

You acknowledge that we may, at any time, required to verify the correctness of this information and in order to do so may require additional documentary proof from you, failing which we reserve the right to suspend or terminate your registration on the Website.

Any information provided by you to us should be complete and truthful to the best of your knowledge. We are not obliged to cross check or verify information provided by you and we will not take any responsibility for any outcome or consequence as a result of you providing incorrect information or concealing any relevant information from us.

You understand that it is your responsibility to protect the information you provide on the Websites including but not limited to your Username, Password, Email address, Contact Details and Mobile number. We will not ask for your user account login password which is only to be entered at the time of login. At no other time should you provide your user account information to any user logged in on the Websites or elsewhere. You undertake that you will not allow / login and then allow, any other person to play from your user account using your username. You specifically understand and agree that we will not incur any liability for information provided by you to anyone which may result in your user account on the Websites being exposed or misused by any other person.

You agree to use your user account with us, solely for the purpose of playing on the Websites and the Apps and for transactions which you may have to carry out in connection with availing the Services thereon. Use or attempted use of your user account for any reason other than what is stated in the Terms may result in immediate termination of your user account and forfeiture of any prize, bonus or balance in the user account.

You also understand and agree that deposits in your user account maintained with us are purely for the purpose of participation in Cash Contest made available on the Portal.

You understand and agree that you cannot transfer any sum from your user account with us to the account of another registered user on the Portal except as may be permitted by us and is subject to restrictions and conditions as may be prescribed.

We are legally obliged to deduct tax at source (TDS) on winnings of more than 10,000/- in a single tournament, as the case may be. In these cases, you will be required to furnish your Permanent Account Number (PAN) duly issued to you by the Income Tax authorities if you have not already done so. TDS at the rate of 31.20%, or such other rate as may be prescribed by law at the relevant time, will automatically be deducted from such winnings and the rest will be credited to your Beat My Squad wallet. Withdrawal of these winnings will only be permitted upon your providing your correct PAN details. These limits and rates are subject to change as per the prevailing rules and regulations. Our obligation in this regard is limited to deducting TDS as required by law and providing you an appropriate certificate of tax deduction. We neither advise you nor shall in any manner be responsible for your individual tax matters.

We reserve the right to verify your PAN from time to time and to cancel any prize if your PAN be found inconsistent in our verification process.

User Account validation and personal information verification

Beat My Squad may from time to time attempt to validate its Beat My Squads' user accounts. These attempts may be made via a phone call or via email. In the event that we are not able to get in touch with you the first time around, we will make additional attempts to establish contact with you. If the phone number and email provided by you is not correct, we bear no responsibility for the Services being interrupted due to our being unable to establish contact with you.

If we are unable to reach you or if the validation is unsuccessful, we reserve the right to disallow you from logging into the Portal or reduce your play limits and/or Add Cash limits until we are able to satisfactorily validate your user account. We will in such events email you to notify you of the next steps regarding user account validation. We may also ask you for proof of identification and proof of address from time to time.

Upon receipt of suitable documents, we will try our best to enable your user account at the earliest. However, it may take a few business days to reinstate your user account.

In the event that we have made several attempts to reach out to you but have been unable to do so, we also reserve the right to permanently suspend your user account and refund the amount.

The Privacy Policy of our Portal form a part of the Terms. All personal information which is of such nature that requires protection from unauthorized dissemination shall be dealt with in the manner provided in the Privacy Policy of the Portal.

Anti-Cheating and Anti-Collusion:

You undertake that you yourself will play in Fantasy Cricket in which you have registered/joined and not use any form of external assistance to play. You shall not add unauthorized components, create or use cheats, exploits, bots, hacks or any other third-party software designed to modify the Websites or use any third-party software that intercepts, mines or otherwise collects information from or through the Websites or through any Services. Any attempt to employ any such external assistance is strictly prohibited. Formation of teams for the purpose of collusion between you and any other user(s) for participating in Contest organized on the Websites or any other form of cheating is strictly prohibited. When collusion or cheating is detected on www.Beat My Squad.com, we shall settle the Contest and may take further appropriate action against offending users in terms hereof including banning access to the Portal and any or all Services.

Money Laundering: You are prohibited from doing any activity on the Website that may be construed as money laundering, including, without limitation, attempting to withdraw cash from unutilized cash added through credit cards or deliberately losing money to a certain Beat My Squad(s).

Anti-SPAMMING: Sending SPAM emails or any other form of unsolicited communication for obtaining registrations on the Website to benefit from any of our promotional program or for any other purpose is strictly prohibited.

Multiple IDs: Your registration on the Portal is restricted to a single user account which will be used by you to avail the Services provided on the Portal. You are prohibited from creating or using multiple user IDs for registering on the Portal. You may not create a login name or password or upload, distribute, transmit, publish or post content through or on the Websites or through any service or facility including any messaging facility provided by the Websites which : is libelous, defamatory, obscene, intimidating, invasive of privacy, abusive, illegal, harassing; contains expressions of hatred, hurting religious sentiments, racial discrimination or pornography; is otherwise objectionable or undesirable (whether or not unlawful); would constitute incitement to commit a criminal offence; violates the rights of any person; is aimed at soliciting donations or other form of help; violates the intellectual property of any person; disparage in any manner Beat My Squad any of its subsidiaries, affiliates, licensors, associates, partners, sponsors, products, services, or websites; promotes a competing service or product; or violates any laws. In the event we determine that the login name created by you is indecent, objectionable, offensive or otherwise undesirable, we shall notify you of the same and you shall promptly provide us with an alternate login name so that we can change your existing login name to the new name provided by you. If you fail to provide an alternate name, we reserve the right to either permanently suspend your user account or restore your user account only after a different acceptable login name has been provided by you. You shall not host, intercept, emulate or redirect proprietary communication protocols, used by the Portal, if any, regardless of the method used, including protocol emulation, reverse engineering or modification of the Portal or any files that are part of the Portal. You shall not frame the Portal. You may not impose editorial comments, commercial material or any information on the Websites, alter or modify Content on the Websites, or remove, obliterate or obstruct any proprietary notices or labels. You shall not use Services on the Portal for commercial purposes including but not limited to use in a cyber cafe as a computer gaming centre, network play over the Internet or through gaming networks or connection to an unauthorized server that copies the gaming experience on the Website. You shall not upload, distribute or publish through the Portal, any content which may contain viruses or computer contaminants (as defined in the Information Technology Act 2000 or such other laws in force in India at the relevant time) which may interrupt, destroy, limit the functionality or disrupt any software, hardware or other equipment belonging to us or that aids in providing the services offered by us. You shall not disseminate or upload viruses, programs, or software whether it is harmful to the Websites or not. Additionally, you shall not impersonate another person or user, attempt to get a password, other user account information, or other private information from a user, or harvest email addresses or other information. You shall not purchase, sell, trade, rent, lease, license, grant a security interest in, or transfer your user account, Content, currency, points, standings, rankings, ratings, or any other attributes appearing in, originating from or associated with the Portal. Any form of fraudulent activity including, attempting to use or using any other person's credit card(s), debit cards, net-banking usernames, passwords, authorization codes, prepaid cash cards, mobile phones for adding cash to your user account is strictly prohibited. Accessing or attempting to access the Services through someone else's user account is strictly prohibited. Winnings, bonuses and prizes are unique to the Beat My Squad and are non-transferable. In the event you attempt to transfer any winnings, bonuses or prizes, these will be forfeited.

You shall not post any material or comment, on any media available for public access, which in our sole discretion, is defamatory or detrimental to our business interests, notwithstanding the fact that such media is not owned or controlled by us. In addition to any other action that we may take pursuant to the provision hereof, we reserve the right to remove any and all material or comments posted by you and restrict your access to any media available for public access that is either controlled or moderate by us; when in our sole opinion, any such material or comments posted by you is defamatory or detrimental to our business interests.

Payments and Beat My Squad Funds

All transactions on the Portal shall be in Indian Rupees. Once you register on our Portal, we maintain a user account for you to keep a record of all your transactions with us. Payments connected with participation in Cash Contest have to be made through your Beat My Squad user account. All cash prizes won by you are credited by us into this user account. When making a payment, please ensure that the instrument used to make the payment is your own and is used to Add Cash into your user account only. Subject to the Add Cash limits specified by us from time to time, you are free to deposit as much money as you want in your user account for the purpose of participating in Cash contest on the Portal.

Beat My Squad wants you to play responsibly on the Android Application. The ability to Add Cash in your user account shall be subject to monthly Add Cash limits which we can be set by us with undertakings, indemnity, waiver and verification conditions as we deem appropriate in our sole discretion. Credit card, Debit card, prepaid cash cards and internet banking payments are processed through third party payment gateways. Similarly, other payment modes also require an authorization by the intermediary which processes payments. We are not responsible for delays or denials at their end and processing of payments will be solely in terms of their policies and procedures without any responsibility or risk at our end. If there are any issues in connection with adding cash, a complaint may be sent to us following the complaints procedure provided in "Complaints and disputes" section below. You agree that in such an event of your credit being delayed or eventually declined for reasons beyond our control, we will not be held liable in any manner whatsoever. Once a payment/transaction is authorized, the funds are credited to your user account and are available for you to play Cash contest.

We have the right to cancel a transaction at any point of time solely according to our discretion in which case if the payment is successful, then the transaction will be reversed, and the money credited back to your payment instrument. Beat My Squad funds are held in trust by us in specified bank accounts. Beat My Squad keeps all Beat My Squads' funds unencumbered which will be remitted to you in due course subject to the terms and conditions applicable to withdrawal of funds. Funds held in your user account are held separately from our corporate funds. Even in the highly unlikely event of an insolvency proceeding, you claims on the deposits will be given preference over all other claims to the extent permissible by law.

Withdrawals

1.      You may withdraw your winnings by means of an electronic bank to bank transfer for the amount of winnings.
2. You agree that all withdrawals you make are governed by the following conditions:

o    Beat My Squad can ask you for KYC documents to verify your address and identity at any stage. Withdrawals will be permitted only from accounts for which such KYC process is complete.
o    You can choose to withdraw money from your user account at any time, subject to prize money withdrawal restrictions, by notifying us of your withdrawal request.
o    Once notified, post verification of the withdrawal request, we may disburse the specified amount by electronic transfer.
o    In case of non-availability of your bank account details, the Beat My Squad may require you to provide those details to process the refund/ withdrawal. We also reserve the right to disburse the amount on the financial instrument used to Add Cash to your user account.
o    We will attempt our best to process your withdrawals in a timely manner, but there could be delays due to the time required for verification and completing the withdrawal transaction. We shall not be liable to pay you any form of compensation for the reason of delays in remitting payments to you from your user account.
o    To be eligible to win a prize, you must be a resident of India and accessing the Services of Beat My Squad on the Services from India.

If you are a prize winner resident in India and physically present in India while accessing the services of Beat My Squad but not an Indian citizen, we will remit your winnings in Indian Rupees to the address/bank account given by you, provided, the address and bank account is within India.

Service Disruptions

You may face Service disruptions, including, but not limited to disconnection or communication interferences due to issues in the internet infrastructure used for providing or accessing the Services or due to issues with the hardware and software used by you. You understand that Beat My Squad has no control over these factors. Beat My Squad shall not be responsible for any interruption in Services and you take full responsibility for any risk of loss due to Service interruptions for any such reason.

You understand, acknowledge and agree to the fact that if you are unable to play in any contest due to any error or omission directly attributable to Beat My Squad, including technical or other glitches at our end, the settlement of such contest will be cancelled and entry fee would be refunded. It is clarified that, notwithstanding any limitation of liability as specified herein, Play Beat My Squad specifically disclaims any liability in the case of contest where there is no money paid by you. You agree that under no circumstances shall you compel Play Beat My Squad or hold Play Beat My Squad liable to pay you any amount over and above the service charges for any of the aforementioned errors/omissions of Beat My Squad.

Content

All content and material on the Portal including but not limited to information, images, marks, logos, designs, pictures, graphics, text content, hyperlinks, multimedia clips, animation, contest and software (collectively referred to as "Content"), whether or not belonging to Beat My Squad, are protected by applicable intellectual property laws. Additionally, all chat content, messages, images, recommendations, emails, images sent by any user can be logged/recorded by us and shall form part of Content and Beat My Squad is free to use this material in any manner whatsoever.

The Portal may contain information about or hyperlinks to third parties. In such a cases, we are not responsible in any manner and do not extend any express or implied warranty to the accuracy, integrity or quality of the content belonging to such third party websites or apps. If you rely on any third party Content posted on any website or app which does not belong to Beat My Squad, you may do so solely at your own risk and liability.

If you visit any third party website or app through a third party Content posted on the Portal, you will be subject to terms and conditions applicable to such third party website or app. We neither control nor are responsible for content on such third-party websites or apps. The fact of a link existing on our Portal to a third-party website or app is not an endorsement of that website or app by us.

License Agreement & Intellectual Property

All Content on the Website and Android Application shall be utilized only for the purpose of availing Services in conformity with the Terms. You acknowledge that all ownership rights and all copyright and other intellectual property rights in the Content are owned by Beat My Squad or our licensors and that you have no right title or other interest in any such items except as expressly stated in the Terms. You are granted a personal, non-exclusive, non-assignable and non-transferable license to use the Content solely for the purposes of accessing and using the Services and for no other purpose whatsoever. You shall not sublicense, assign or transfer the license granted to you, or rent or lease or part with the whole or any part of such license or of the Content included in such license. You may not transfer, copy, reproduce, distribute, exploit, reverse engineer, disassemble, translate, decode, alter, make derivations from or make any other use of Content on the Website and Android Application in any manner other than as permitted for obtaining the Services provided on the website and Android Application. You may not hyperlink the Portal to any other website without permission from us. You may access information on download and print extracts from the Portal for your personal use only. No right, title or interest in any downloaded materials or software is transferred to you by downloading and you are expressly prohibited from using such materials for any commercial purpose unless agreed with us in writing.

Voluntary termination

You are free to discontinue use of the Services on any Website at any time by intimating us of your desire to do so by sending an email to us at support@Beat My Squad.com as the case may be. If at such time, there is a positive withdrawable cash balance in your user account, we will, subject to satisfactory verification, disburse the same to you by online transfer in a timely manner.

User Account suspension

We may suspend or otherwise put restrictions on your access to the Services on the Websites during investigation for any of the following reasons:
·         Suspected violation of Terms or other abuse of your user account;
·         Suspected breach of security of your user account; or
·         If there have been charge-backs on your user account.
· Our decision to suspend or restrict Service or any part thereof as we deem appropriate shall be final and binding on you.

Breach and Consequences

In the event of breach of any of the Terms being evidenced from our investigation or if there is reasonable belief, in our sole discretion, that your continued access to the Portal or any Website is detrimental to the interests of Beat My Squad, our other users or the general public; we may in our sole discretion take any or all of the following actions:
·         Restrict contest between users suspected of colluding or cheating;
·         Permanently suspend your user account on the Website;
·         Forfeit the cash balance in your user account;
·         Demand damages for breach and take appropriate civil action to recover such damages; and/or
·         Initiate prosecution for violations that amount to offences in law.
· Additionally, in the event of committing material breach hereof, we reserve the right to bar you from future registration on the Website and Android Application. The decision of Beat My Squad on the action to be taken as a consequence of breach shall be final and binding on you. Any action taken by Beat My Squad shall be without prejudice to our other rights and remedies available in law or equity.

Complaints, Grievances & Disputes

If you have a complaint, you should in the first instance contact the customer support team at support@Beat My Squad.com or write to us following the procedure given in the respective Contact Us section on the relevant Website and on Android Application. Complaints should be made as soon as possible after circumstances arise that cause you to have a complaint. You accept that any complaints and disputes are and remain confidential both whilst a resolution is sought and afterwards. You agree that you shall not disclose the existence, nature or any detail of any complaint or dispute to any third party. Beat My Squad shall make efforts to resolve complaints within reasonable time. Our decision on complaints shall be final and binding on you.

Modifications and Alterations

We may alter or modify the Terms at any time without giving prior notice to you. We may choose to notify of some changes in the Terms either by email or by displaying a message on the Portal; however, our notification of any change shall not waive your obligation to keep yourself updated about the changes in the Terms. Your continued use of any Portal and/or any Services offered constitutes your unconditional acceptance of the modified or amended Terms.

We may also post supplementary conditions for any Services that may be offered. In such an event, your use of those Services will be governed by the Terms as well as any such supplementary terms that those Services may be subject to.

Limitation of liability

In addition to specific references to limitation of liability of Beat My Squad elsewhere in the Terms, under no circumstances (including, without limitation, in contract, negligence or other tort), Beat My Squad shall be liable for any injury, loss, claim, loss of data, loss of income, loss of profit or loss of opportunity, loss of or damage to property, general damages or any direct, indirect, special, incidental, consequential, exemplary or punitive damages of any kind whatsoever arising out of or in connection with your access to, or use of, or inability to access or use, the Services on any Website or App in the Portal. You further agree to indemnify us and our service providers and licensors against any claims in respect of any such matter. Without limiting the generality of the foregoing, you specifically acknowledge, agree and accept that we are not liable to you for: the defamatory, undesirable or illegal conduct of any other user of the Services; any loss whatsoever arising from the use, abuse or misuse of your user account or any feature of our Services on the Website and Android Application; Any loss incurred in transmitting information from or to us or from or to our Website by the internet or by other connecting media; any technical failures, breakdowns, defects, delays, interruptions, improper or manipulated data transmission, data loss or corruption or communications’ infrastructure failure, viruses or any other adverse technological occurrences arising in connection with your access to or use of our Services; the accuracy, completeness or currency of any information services provided on the Websites and Apps; any delay or failure on our part to intimate you where we may have concerns about your activities; and Your activities / transactions on third party websites or apps Portal accessed through links or advertisements posted in the Portal.

Disclaimer

The Services on the Website and Android Application and the Content present on it are provided strictly on "as is" basis with all faults or failings. Any representations, warranties, conditions or guarantee whatsoever, express or implied (including, without limitation, any implied warranty of accuracy, completeness, uninterrupted provision, quality, merchantability, fitness for a particular purpose or non-infringement) are specifically excluded to the fullest extent permitted by law. Beat My Squad does not ensure or guarantee continuous, error-free, secure or virus- free operation of the Portal or its Content including software, Contest, your user account, the transactions in your user account or continued operation or availability of any facility on the website.

Additionally, Play Beat My Squad   does not promise or ensure that you will be able to access your user account or obtain Services whenever you want. It is entirely possible that you may not be able to access your user account or the Services provided by Beat My Squad at times or for extended periods of time due to, but not limited to, system maintenance and updates. Beat My Squad disclaims responsibility and liability for any harm resulting from cancellation of any Contest organized by it. If you are a cash Beat My Squad on the Portal, you acknowledge and agree that you will not be entitled to any refund in case of any service outages that may be caused by failures of our service providers, computer viruses or contaminants, natural disasters, war, civil disturbance, or any other cause beyond the reasonable control of Beat My Squad. Beat My Squad specifically disclaims any liability in connection with Contest or events made available or organized on the Portal which may require specific statutory permissions, in the event such permissions are denied or cancelled whether prior to or during such Contest or event. Beat My Squad specifically disclaims any liability in connection with your transactions with third parties which may have advertisements or are hyperlinked on the Website and Android Application. Beat My Squad disclaims any liability in connection with violation of intellectual property rights of any party with respect to third party Content or user content posted on our Website and Android Application. Intellectual property rights in any Content not belonging to us belong to the respective owners and any claims related to such content must be directly addressed to the respective owners. Beat My Squad specifically disclaims any liability arising out of the acts or omissions of the infrastructure providers or otherwise failure of internet services used for providing and accessing the Services. Beat My Squad disclaims liability for any risk or loss resulting to you from your participation in Cash Contest, including all risk of financial loss.

Indemnity

To the extent permitted by law, and in consideration for being allowed to participate in the Activity, you hereby agree to indemnify, save and hold harmless and defend us (to the extent of all benefits and awards, cost of litigation, disbursements and reasonable attorney's fees that we may incur in connection therewith including any direct, indirect or consequential losses, any loss of profit and loss of reputation) from any claims, actions, suits, taxes, damages, injuries, causes of action, penalties, interest, demands, expenses and/or awards asserted or brought against us by any person in connection with: Infringement of their intellectual property rights by your publication of any content on our Website. defamatory, offensive or illegal conduct of any other Beat My Squad or for anything that turns out to be misleading, inaccurate, defamatory, threatening, obscene or otherwise illegal whether originating from another Beat My Squad or otherwise; use, abuse or misuse of your user account on our Website in any manner whatsoever; any disconnections, technical failures, system breakdowns, defects, delays, interruptions, manipulated or improper data transmission, loss or corruption of data or communication lines failure, distributed denial of service attacks, viruses or any other adverse technological occurrences arising in connection with your access to or use of our Website; and access of your user account by any other person accessing the Services using your username or password, whether or not with your authorization.

Usage of Beat My Squad

Any person ("User") accessing Beat My Squad (On Beat My Squad platform') for participating in the various contests and contest (including fantasy contest), available on Beat My Squad platform ("Contest(s)") (' Beat My Squad Services') shall be bound by these Terms and Conditions, and all other rules, regulations and terms of use referred to herein or provided by Beat My Squad in relation to any Beat My Squad Services.

Beat My Squad shall be entitled to modify these Terms and Conditions, rules, regulations and terms of use referred to herein or provided by Beat My Squad in relation to any Beat My Squad Services, at any time, by posting the same on Beat My Squad. Use of Beat My Squad constitutes the User's acceptance of such Terms and Conditions, rules, regulations and terms of use referred to herein or provided by Beat My Squad in relation to any Beat My Squad Services, as may be amended from time to time. Beat My Squad may, at its sole discretion, also notify the User of any change or modification in these Terms and Conditions, rules, regulations and terms of use referred to herein or provided by Beat My Squad, by way of sending an email to the User's registered email address or posting notifications in the User accounts. The User may then exercise the options provided in such an email or notification to indicate non-acceptance of the modified Terms and Conditions, rules, regulations and terms of use referred to herein or provided by Beat My Squad. If such options are not exercised by the User within the time frame prescribed in the email or notification, the User will be deemed to have accepted the modified Terms and Conditions, rules, regulations and terms of use referred to herein or provided by Beat My Squad.

Certain Beat My Squad Services being provided on Beat My Squad may be subject to additional rules and regulations set down in that respect. To the extent that these Terms and Conditions are inconsistent with the additional conditions set down, the additional conditions shall prevail.

Beat My Squad may, at its sole and absolute discretion:

Restrict, suspend, or terminate any User's access to all or any part of Beat My Squad or Beat My Squad Platform Services; Change, suspend, or discontinue all or any part of the Beat My Squad Platform Services; Reject, move, or remove any material that may be submitted by a User; Move or remove any content that is available on Beat My Squad Platform; Deactivate or delete a User's account and all related information and files on the account; Establish general practices and limits concerning use of Beat My Squad Platform; Offer discounts to its users in form it deems fit ("Cash Bonus"). All such discounts shall be credited in a separate account called as Bonus Account.

Revise or make additions and/or deletions to the roster of Beat My Squads available for selection in a Contest on account of revisions to the roster of Beat My Squads involved in the relevant Sports Event; Assign its rights and liabilities to all User accounts hereunder to any entity (post such assignment intimation of such assignment shall be sent to all Users to their registered email ids)In the event any User breaches, or Beat My Squad reasonably believes that such User has breached these Terms and Conditions, or has illegally or improperly used Beat My Squad or the Beat My Squad Services, Beat My Squad may, at its sole and absolute discretion, and without any notice to the User, restrict, suspend or terminate such User's access to all or any part of Beat My Squad Contests or the Beat My Squad Platform, deactivate or delete the User's account and all related information on the account, delete any content posted by the User on Beat My Squad and further, take technical and legal steps as it deems necessary.

If Beat My Squad charges its Users a platform fee in respect of any Beat My Squad Services, Beat My Squad shall, without delay, repay such platform fee in the event of suspension or removal of the User's account or Beat My Squad Services on account of any negligence or deficiency on the part of Beat My Squad, but not if such suspension or removal is effected due to: any breach or inadequate performance by the User of any of these Terms and Conditions; or any circumstances beyond the reasonable control of Beat My Squad.

Users consent to receiving communications such as announcements, administrative messages and advertisements from Beat My Squad or any of its partners, licensors or associates.

Beat My Squad includes a combination of content created by Beat My Squad, its partners, affiliates, licensors, associates and/or Users. The intellectual property rights ("Intellectual Property Rights") in all software underlying Beat My Squad and the Beat My Squad Platform and material published on Beat My Squad, including (but not limited to) contest, Contests, software, advertisements, written content, photographs, graphics, images, illustrations, marks, logos, audio or video clippings and Flash animation, is owned by Beat My Squad, its partners, licensors and/or associates. Users may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or content on Beat My Squad either in whole or in part without express written license from Beat My Squad.

Users may request permission to use any Beat My Squad content by writing in to Beat My Squad Helpdesk.

Users are solely responsible for all materials (whether publicly posted or privately transmitted) that they upload, post, e-mail, transmit, or otherwise make available on Beat My Squad ("Users' Content"). Each User represents and warrants that he/she owns all Intellectual Property Rights in the User's Content and that no part of the User's Content infringes any third party rights. Users further confirm and undertake to not display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights of any third party on Beat My Squad. Users agree to indemnify and hold harmless Beat My Squad, its directors, employees, affiliates and assigns against all costs, damages, loss and harm including towards litigation costs and counsel fees, in respect of any third party claims that may be initiated including for infringement of Intellectual Property Rights arising out of such display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on Beat My Squad, by such User or through the User's commissions or omissions.

Users hereby grant to Beat My Squad and its affiliates, partners, licensors and associates a worldwide, irrevocable, royalty-free, non-exclusive, sub-licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish Users' Content for any of the following purposes:
displaying Users' Content on Beat My Squad distributing Users' Content, either electronically or via other media, to other Users seeking to download or otherwise acquire it, and/or storing Users' Content in a remote database accessible by end users, for a charge.

This license shall apply to the distribution and the storage of Users' Content in any form, medium, or technology. All names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on Beat My Squad(s) belonging to any person (including User), entity or third party are recognized as proprietary to the respective owners and any claims, controversy or issues against these names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights must be directly addressed to the respective parties under notice to Beat My Squad.

Third Party Sites, Services and Products

Beat My Squad may contain links to other Internet sites owned and operated by third parties. Users' use of each of those sites is subject to the conditions, if any, posted by the sites. Beat My Squad does not exercise control over any Internet sites apart from Beat My Squadand cannot be held responsible for any content residing in any third-party Internet site. Beat My Squad's inclusion of third-party content or links to third-party Internet sites is not an endorsement by Beat My Squad of such third-party Internet site. Users' correspondence, transactions/offers or related activities with third parties, including payment providers and verification service providers, are solely between the User and that third party. Users' correspondence, transactions and usage of the services/offers of such third party shall be subject to the terms and conditions, policies and other service terms adopted/implemented by such third party, and the User shall be solely responsible for reviewing the same prior to transacting or availing of the services/offers of such third party. User agrees that Beat My Squad will not be responsible or liable for any loss or damage of any sort incurred as a result of any such transactions/offers with third parties. Any questions, complaints, or claims related to any third party product or service should be directed to the appropriate vendor.

Beat My Squad contains content that is created by Beat My Squad as well as content provided by third parties. Beat My Squad does not guarantee the accuracy, integrity, quality of the content provided by third parties and such content may not relied upon by the Users in utilizing the Beat My Squad Services provided on Beat My Squad including while participating in any of the contests hosted on Beat My Squad.

Privacy Policy

All information collected from Users, such as registration and debit/credit card information, is subject to Beat My Squad's Privacy Policy which is available at Privacy Policy.

User Conduct

Users agree to abide by these Terms and Conditions and all other rules, regulations and terms of use of the Website and Android Application. In the event User does not abide by these Terms and Conditions and all other rules, regulations and terms of use, Beat My Squad may, at its sole and absolute discretion, take necessary remedial action, including but not limited to: restricting, suspending, or terminating any User's access to all or any part of Beat My Squad Services; deactivating or deleting a User's account and all related information and files on the account. Any amount remaining unused in the User's Contest account or Winnings Account on the date of deactivation or deletion shall be transferred to the User's bank account on record with Beat My Squad subject to a processing fee (if any) applicable on such transfers as set out herein; or refraining from awarding any prize(s) to such User.

Users agree to provide true, accurate, current and complete information at the time of registration and at all other times (as required by Beat My Squad). Users further agree to update and keep updated their registration information. A User shall not register or operate more than one User account with Beat My Squad. Users agree to ensure that they can receive all communication from Beat My Squad by marking e-mails or sending SMSs from Beat My Squad as part of their "safe senders" list. Beat My Squad shall not be held liable if any e-mail/SMS remains unread by a User as a result of such e-mail getting delivered to the User's junk or spam folder.

Any password issued by Beat My Squad to a User may not be revealed to anyone else. Users may not use anyone else's password. Users are responsible for maintaining the confidentiality of their accounts and passwords. Users agree to immediately notify Beat My Squad of any unauthorized use of their passwords or accounts or any other breach of security. Users agree to exit/log-out of their accounts at the end of each session. Beat My Squad shall not be responsible for any loss or damage that may result if the User fails to comply with these requirements. Users agree not to use cheats, exploits, automation, software, bots, hacks or any unauthorized third party software designed to modify or interfere with Beat My Squad Services and/or Beat My Squad experience or assist in such activity. Users agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying Beat My Squad or Beat My Squad’s Services.

Users agree that without Beat My Squad's express written consent, they shall not modify or cause to be modified any files or software that are part of Beat My Squad's Services.
Users agree not to disrupt, overburden, or aid or assist in the disruption or overburdening of (a) any computer or server used to offer or support Beat My Squad or the Beat My Squad’s Services (each a "Server"); or (2) the enjoyment of Beat My Squad Services by any other User or person.

Users agree not to institute, assist or become involved in any type of attack, including without limitation to distribution of a virus, denial of service, or other attempts to disrupt Beat My Squad Services or any other person's use or enjoyment of Beat My Squad Services.

Users shall not attempt to gain unauthorized access to the User accounts, Servers or networks connected to Beat My Squad Services by any means other than the User interface provided by Beat My Squad, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that underlies or is part of Beat My Squad Services.

Without limiting the foregoing, Users agree not to use Beat My Squad for any of the following:

To engage in any obscene, offensive, indecent, racial, communal, anti-national, objectionable, defamatory or abusive action or communication; To harass, stalk, threaten, or otherwise violate any legal rights of other individuals; To publish, post, upload, e-mail, distribute, or disseminate (collectively, "Transmit") any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful content; To Transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person's computer, Beat My Squad, any software, hardware, or telecommunications equipment; To advertise, offer or sell any goods or services for any commercial purpose on Beat My Squad without the express written consent of Beat My Squad; To download any file, recompile or disassemble or otherwise affect our products that you know or reasonably should know cannot be legally obtained in such manner; To falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or the source of software or other material; To restrict or inhibit any other user from using and enjoying any public area within our sites; To collect or store personal information about other Users; To interfere with or disrupt Beat My Squad, servers, or networks; To impersonate any person or entity, including, but not limited to, a representative of Beat My Squad, or falsely state or otherwise misrepresent User's affiliation with a person or entity; To forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through Beat My Squad or to manipulate User's presence on Beat My Squad(s); To take any action that imposes an unreasonably or disproportionately large load on our infrastructure; To engage in any illegal activities. You agree to use our bulletin board services, chat areas, news groups, forums, communities and/or message or communication facilities (collectively, the "Forums") only to send and receive messages and material that are proper and related to that particular Forum.

If a User chooses a username that, in Beat My Squad's considered opinion is obscene, indecent, abusive or that might subject Beat My Squad to public disparagement or scorn, Beat My Squad reserves the right, without prior notice to the User, to change such username and intimate the User or delete such username and posts from Beat My Squad, deny such User access to Beat My Squad, or any combination of these options.

Unauthorized access to Beat My Squad is a breach of these Terms and Conditions, and a violation of the law. Users agree not to access Beat My Squad by any means other than through the interface that is provided by Beat My Squad for use in accessing Beat My Squad. Users agree not to use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor, or copy any part of our sites, except those automated means that we have approved in advance and in writing.

Use of Beat My Squad is subject to existing laws and legal processes. Nothing contained in these Terms and Conditions shall limit Beat My Squad's right to comply with governmental, court, and law-enforcement requests or requirements relating to Users' use of Beat My Squad.

Users may reach out to Beat My Squad through – Helpdesk if the user has any concerns with regard to a match and/or contest within Forty Eight (48) hours of winner declaration for the concerned contest.

Persons below the age of eighteen (18) years are not allowed to participate on any of the contests, contest (by whatever name called) on the Beat My Squad Platform. The Users will have to disclose their real age at the time of getting access into the Beat My Squad Platform. Beat My Squad may not be held responsible for any content contributed by Users on the Beat My Squad.

Conditions of Participation:

By entering a Contest, user agrees to be bound by these Terms and the decisions of Beat My Squad. Subject to the terms and conditions stipulated herein below, the Company, at its sole discretion, may disqualify any user from a Contest, refuse to award benefits or prizes and require the return of any prizes, if the user engages in unfair conduct, which the Company deems to be improper, unfair or otherwise adverse to the operation of the Contest or is in any way detrimental to other Users which includes, but is not limited to: Falsifying ones’ own personal information (including, but not limited to, name, email address, bank account details and/or any other information or documentation as may be requested by Beat My Squad to enter a contest and/or claim a prize/winning.; Engaging in any type of financial fraud or misrepresentation including unauthorized use of credit/debit instruments, payment wallet accounts etc. to enter a Contest or claim a prize. It is expressly clarified that the onus to prove otherwise shall solely lie on the user.; Colluding with any other user(s) or engaging in any type of syndicate play; Any violation of Contest rules or the Terms of Use; Accumulating points or prizes through unauthorized methods such as automated bots, or other automated means; Using automated means (including but not limited to harvesting bots, robots, parser, spiders or screen scrapers) to obtain, collect or access any information on the Website , Android Application or of any User for any purpose.

Any type of Cash Bonus misuse, misuse of the Invite Friends, or misuse of any other offers or promotions; Tampering with the administration of a Contest or trying to in any way tamper with the computer programs or any security measure associated with a Contest; Obtaining other users’ information without their express consent and/or knowledge and/or spamming other users (Spamming may include but shall not be limited to send unsolicited emails to users, sending bulk emails to Beat My Squad Users, sending unwarranted email content either to selected Users or in bulk); or Abusing the Website in any way (‘unparliamentary language, slangs or disrespectful words’ are some of the examples of Abuse) It is clarified that in case a User is found to be in violation of this policy, Beat My Squad reserves its right to initiate appropriate Civil/Criminal remedies as it may be advised other than forfeiture and/or recovery of prize money if any.

Registration for a contest

In order to register for the Contest(s), Participants are required to accurately provide the following information:

Participants are also required to confirm that they have read, and shall abide by, these Terms and Conditions.

In the event a Participant indicates, while entering an address, that he/she is a resident of either Assam, Odisha, Sikkim, Nagaland or Telangana, such Participant will not be permitted to proceed to sign up for any match in the paid version of the Contest as described below. For this a separate Pop Up disclaimer will be shown while joining any contest regarding resident’s state and age.

Once the Participants have entered the above information, and clicked on the "register" tab, and such Participants are above the age of 18 years, they are sent an email confirming their registration and containing their login information.

Contest(s), Participation and Prizes

As part of its services, Beat My Squad may make available the contest(s) on the Beat My Squad platform. Currently only, Fantasy Cricket Contest is available on Beat My Squad platform: and Individual users wishing to participate in the contest ("Participants") are invited to create their own fantasy teams ("Team/s") consisting of real life cricketers, involved in the real-life cricket match (as applicable), series or tournament to which the fantasy contest relates. Beat My Squad offers its platform to Participants for fantasy contest Contest(s) being created relating to each Sport Event, and Participants can participate in such Contest(s) with their Teams.

Depending upon the circumstances of each match, the participants can edit their teams till the official match start time as declared by the officials of the Sport Event or adjusted deadline, as specified below.

Beat My Squad reserves the right to abandon a specific round or adjust the deadline of a round in certain specific, uncertain scenarios, which are beyond Beat My Squad’s reasonable control, including but not limited to the ones’ mentioned herein below:

Actual match start time is before the official deadline: Beat My Squad reserves the right to adjust the deadline by a Maximum of 15 minutes or 4 overs bowled, whichever is less, before the official match start time.

In cases where official match time cannot be verified by Beat My Squad through reliable and/or publicly available sources, Beat My Squad reserves the right to adjust the deadline to such a time by which a maximum of 4 overs in the given match are bowled.

Actual match start time is after the official deadline: Beat My Squad reserves the right to extend the deadline or abandon the contest/contest based on the circumstances such as delayed toss, interruption on account of weather, non-appearance of teams, technical/equipment glitches causing delays etc.

Beat My Squad shall endeavor to send communications through emails and/or SMS communication, about any such change as is contemplated in the aforementioned paragraphs to keep the User updated.

Teams are awarded points on the basis of the real life cricketers' (as applicable) performances at the end of a designated match, match or tournament of the Contest(s). The Participant(s) whose Team(s) have achieved the highest aggregate score(s) in the Contest(s) shall be declared winners ("Winners"). In certain pre-specified Contests, there may be more than one Winner and distribution of prizes to such Winners will be in increasing order of their Team's aggregate score at the end of the designated match(s) of the Contests.

The Contest(s) across the Beat My Squad Services shall, in addition to the Terms and Conditions, rules and regulations mentioned herein, be governed by: "Fantasy Rules" available at How To Play - Fantasy Cricket.

Other rules and regulations (including rules and regulation in relation to any payments made to participate in the Contest(s); and all Participants agree to abide by the same. Currently, there are paid versions of the Contest(s) made available on Beat My Squad platform. Users may participate in the Contest(s) by paying the pre-designated amount as provided on the relevant Contest page. The ‘pre-designated amount’ means and includes pre-determined platform fee for accessing Beat My Squad services and pre-determined participant's contribution towards prize money pool. The Participant with the highest aggregate points at the end of the pre-determined match shall be eligible to win a pre-designated prize which is disbursed out of prize money pool, as stated on the relevant Contest(s) page.

A Participant may create different Teams for participation in Contest(s) in relation to a Sport Event across the Beat My Squad Services. However, unless Beat My Squad specifies otherwise in relation to any Contest ("Multiple Entry Contest"), Participants acknowledge and agree that they may enter only one Team in any Contest offered in relation to a Sport Event. In case of Multiple Entry Contest(s), a Participant may enter more than one Team in a single Multiple Entry Contest upto 11 teams. In addition, it is expressly clarified that Beat My Squad may, from time to time, restrict the maximum number of Teams that may be created by a single User account (for each format of the contest) or which a single User account may enter in a particular Multiple Entry Contest, in each case to such number as determined by Beat My Squad in its sole discretion.

Participant shall pay a pre-designated amount for participating in the contest(s) being created on the Beat My Squad platform.

In the event a Participant indicates, while entering an address, that he/she is a resident of either Assam, Odisha, Sikkim, Nagaland or Telangana, such Participant will not be permitted to proceed to sign up for the match or contest and may not participate in any paid version of the Contest(s).

In two member and/or three member only public and/or contests, where all participants have entered the contest with the exact same teams, including the Most Preferred Beat My Squad, captain and vice-captain in such event, contest prize money shall be equally divided amongst all participants and the amount shall be deposited in the Beat My Squad winning account of all participants .

In Starting Lineup Feature : Purpose of indicating a Beat My Squad's inclusion in final starting lineup is only to provide information and assist a user in selecting his/her team on Beat My Squad. While indicating a Beat My Squad's inclusion in starting lineup is given by Beat My Squad on the basis of information/data received through feed providers, publicly available information. Users are advised to do a thorough research of their own from official sources and/or other available sources of information. Beat My Squad, shall not take any liability, if a Beat My Squad earlier indicated as 'Playing' does not play or start for any reason whatsoever.

Contest Formats

Currently two formats of contest(s) are made available on Beat My Squad platform (1) Public Contest where Users can participate in a Contest with other Users without any restriction on participation and (2) private contests, where Users can invite specific Users into a Contest and restrict participation to such invited Users. All rules applicable to Contest(s) as set out herein shall be applicable to both formats of the Contest(s). Users by participating in a Contest(s) hereby authorize Beat My Squad to appoint a third party/ Trustee/Escrow Agent to manage users funds on users behalf.

Public contest

In the Public contest format of the Contest(s), Beat My Squad may make available the Contest(s) comprising of 2 - 1000000 Participants or any other pre-designated number of Participants.

Beat My Squad may create this format of the Contest(s) as a paid format and the Winner will be determinable at the end of the match as per rule of the contests.

The number of Participants required to make the Contest(s) operational will be pre-specified and once the number of Participants in such Contest(s) equals the pre-specified number required for that Contest(s), such Contest(s) shall be operational. In case the number of Participants is less than the pre-specified number at the time of commencement of the match, such Contest(s) will not be operational and the pre-designated amount paid by each Participant shall be returned to the account of such User without any charge or deduction.

In certain Contests across the Beat My Squad Services, designated as "Confirmed contests", the Contest(s) shall become operational only when a minimum of two users join a Confirmed Contest. The pre-specified number of winners to be declared in such Contest(s), even if all available Participant slots (as pre-specified in relation to the Contest(s)) remain unfilled. It is clarified that notwithstanding the activation of such Contest(s), Participants can continue to join such Contest(s) till either (i) all available Participant slots of such Contest(s) are filled or (ii) the match to which the Contest (s) relates commences, whichever is earlier. In the event of shortfall in the number of participants joining the Confirmed Contest, Beat My Squad shall continue with such contests and prize pool will be adjusted accordingly.

Private Contest

In the Private contest format of the Contest(s), Beat My Squad enables Users to create a contest ("Private contest") and invite other users, whether existing Users or otherwise, ("Invited User") to create Teams and participate in the Contest(s). Users may create a Private contest to consist of a pre-specified number of Participants that is, consisting of either 2 -500 Participants. The User creating the Private contest shall pay the pre-designated amount for such Private contest and thereby join that Private contest and shall supply a name for the Private contest and be provided with a unique identification code ("contest Code") (which will be issued to the account of such User). The User agrees and understands that once the Private contest is created no change shall be permitted in the terms or constitution of the Private contest, except for a change in the name of the contest. The User creating the Private contest shall provide Beat My Squad with the email address or Facebook account username of Invited Users to enable Beat My Squad to send a message or mail inviting such Invited User to register with Beat My Squad (if necessary) and participate in the Private contest in relation to which the invite has been issued.

In order to participate in the Private contest, an Invited User shall input the contest Code associated with the Private contest and pay the pre-designated amount for the Private contest. Once the number of Participants in a Private contest equals the number of pre-specified Participants for that Private contest, the Private contest shall be rendered operative and no other Invited Users or Users shall be permitted to participate in the Private contest. In the event that any Private contest does not contain the pre-specified number of Participants for that Private contest prior to the commencement of the match/Contest, the Platform will initiate an automatic refund of the amount deposited. Such refund shall be processed after the expiry of the deadline for filling of participants for such Private Contest.

It is clarified that the participation of Invited Users in any Private contest is subject to the pre-specified number of Participants for that Private contest, and Beat My Squad shall not be liable to any person for the inability of any Invited User to participate in any Private contest due to any cause whatsoever, including without limitation due to a hardware or technical malfunction or lack of eligibility of such Invited User to participate in the Contest(s).

Eligibility

The Contest(s) are open only to persons above the age of 18 years.

The Contest(s) are open only to persons, currently residing in India.

Beat My Squad may, in accordance with the laws prevailing in certain Indian states, bar individuals residing in those states from participating in the Contest(s). Currently, individuals residing in the Indian states of Assam, Odisha, Sikkim, Nagaland or Telangana may not participate in the paid version of the Contest as the laws of these states bar persons from participating in contest of skill where participants are required to pay to enter.

Persons who wish to participate must have a valid email address.

Beat My Squad may on receipt of information bar a person from participation and/or withdrawing winning amounts if such person is found to be one with insider knowledge of participating teams in any given contests/match, organizing boards, leagues etc.
Only those Participants who have successfully registered on the Beat My Squad as well as registered prior to each match in accordance with the procedure outlined above shall be eligible to participate in the Contest and win prizes.

Payment Terms

In respect of any transactions entered into on the Beat My Squad platform, including making a payment to participate in the paid versions of Contest(s), Users agree to be bound by the following payment terms:

The payment of pre-designated amount Users make to participate in the Contest(s) is inclusive of the pre-designated platform fee for access to the Beat My Squad Services charged by Beat My Squad and pre-determined participant’s contribution towards prize money pool.

Subject to these Terms and Conditions, all amounts collected from the User are held in a separate non-interest earning bank Accounts. From these bank accounts, the payouts can be made to (a) Users (towards their withdrawals), (b) Beat My Squad (towards its Platform Fees) and to (c) Government (towards TDS on Winnings Amount). Beat My Squad receives only its share of the platform.

The Beat My Squad reserves the right to charge a Platform Fee, which would be specified and notified by Beat My Squad on the Contest page, being created on Beat My Squad platform, prior to a User's joining of such Contest. The Platform Fee (inclusive of applicable tax thereon) will be debited from the User’s account balance and Beat My Squad shall issue an invoice for such debit to the User.

The User may participate in a Contest wherein the User has to contribute a pre-specified contribution towards the Prize Money Pool of such Contest, which will be passed on to the Winner(s) of the Contest after the completion of the Contest as per the terms and conditions of such Contest. It is clarified that Beat My Squad has no right or interest in this Prize Money Pool, and only acts as an intermediary engaged in collecting and distributing the Prize Money Pool in accordance with the Contest terms and conditions. The amount to be paid-in by the User towards the Prize Money Pool would also be debited from the User’s account balance maintained with the Trustee.

Any user availing Beat My Squad services are provided with two categories of accounts for the processing and reconciliation of payments: (i) 'Unutilized' Account, (ii) Winnings Account. It is clarified that in no instance the transfer of any amounts in the User's accounts to any other category of account held by the user or any third party account, including a bank account held by a third party:

User's winnings in any Contest will reflect as credits to the User's Winnings Account. User’s remitting the amount the designated payment gateway shall be credited to User’s Unutlized Account’.

Each time a User participates in any contest on Beat My Squad platform, the pre-designated amount shall be debited in the User’s account. In debiting amounts from the User’s accounts towards the pre-designated amount of such user shall be debited from the User’s Unutilized Account and thereafter, any remaining amount of participation fee shall be debited from the User’s Winning Account.

In case there is any amount remaining to be paid by the User in relation to such User’s participation in any match(s) or Contest(s), the User will be taken to the designated payment gateway to give effect to such payment. In case any amount added by the User through such payment gateway exceeds the remaining amount of the pre-designated amount, the amount in excess shall be transferred to the User’s ‘Unutilized’ Account and will be available for use in participation in any match(s) or Contest(s) or for withdrawal in accordance with these Terms and Conditions.

Debits from the ‘Unutilized’ Account for the purpose of enabling a user’s participation in a Contest shall be made in order of the date of credit of amounts in the ‘Unutilized’ Account, and accordingly amounts credited into ‘Unutilized’ Account earlier in time shall be debited first.

Further, in order to conduct promotional activities, Beat My Squad may gratuitously issue Cash Bonus to the User for the purpose of participation in any Contest(s) and no User shall be permitted to transfer or request the transfer of any amount in to the Cash Bonus. The usage of any Cash Bonus issued shall be subject to the limitations and restrictions, including without limitation, restrictions as to time within which such Cash Bonus must be used, as applied by Beat My Squad and notified to the User at the time of issue of such amount. The issue of any Cash Bonus to the user is subject to the sole discretion of Beat My Squad and cannot be demanded by any User as a matter of right. The issue of any Cash Bonus by Beat My Squad on any day shall not entitle the user to demand the issuance of such Cash Bonus at any subsequent period in time nor create an expectation of recurring issue of such Cash Bonus by Beat My Squad to such User. The Cash Bonus granted to the user may be used by such User for the purpose of setting off against the contribution to prize pool in any Contest, in accordance with these Terms and Conditions. The Cash Bonus shall not be withdraw-able or transferrable to any other account of the User, including the bank account of such User, or of any other User or person, other that as part of the winnings of a User in any Contest(s). In case the User terminates his/her account with Beat My Squad or such account if terminated by Beat My Squad, all Cash Bonus granted to the user shall return to Beat My Squad and the User shall not have any right or interest on such points.

All Cash Bonus credited in the User account shall be valid for unlimited time and can be utilized for joining cash contest.

Users agree that once they confirm a transaction on Beat My Squad, they shall be bound by and make payment for that transaction.

The User acknowledges that subject to time taken for bank reconciliations and such other external dependencies that Beat My Squad has on third parties, any transactions on Beat My Squad Platform may take up to 36 hours to be processed. Any amount paid or transferred into the User's 'Unutilized' Account or Winnings Account may take up to 36 hours to reflect in the User's 'Unutilized' Account or Winnings Account balance. Similarly, the utilization of the Cash Bonus or money debited from 'Unutilized' Account or Winnings Account may take up to 36 hours to reflect in the User's 'Unutilized' Account or Winnings Account balance. Users agree not to raise any complaint or claim against Beat My Squad in respect of any delay, including any lost opportunity to join any Contest or match due to delay in crediting of transaction amount into any of the User's accounts. A transaction, once confirmed, is final and no cancellation is permissible. Beat My Squad may, in certain exceptional circumstances and at its sole and absolute discretion, refund the amount to the User after deducting applicable cancellation charges and taxes. At the time of the transaction, Users may also be required to take note of certain additional terms and conditions and such additional terms and conditions shall also govern the transaction. To the extent that the additional terms and conditions contain any clause that is conflicting with the present terms and conditions, the additional terms and conditions shall prevail.

Tabulation of fantasy points

Beat My Squad may obtain the score feed and other information required for the computation and tabulation of fantasy points from third party service provider(s) and/or official website of the match organizer. In the rare event that any error in the computation or tabulation of fantasy points, selection of winners, abandonment of a match etc., as a result of inaccuracies in or incompleteness of the feed provided by the third party service provider and/or official website of the match organizer comes to its attention, Beat My Squad shall use best efforts to rectify such error prior to the distribution of prizes. However, Beat My Squad hereby clarifies that it relies on the accuracy and completeness of such third party score/statistic feeds and does not itself warrant or make any representations concerning the accuracy thereof and, in any event, shall take no responsibility for inaccuracies in computation and tabulation of fantasy points or the selection of winners as a result of any inaccurate or incomplete scores/statistics received from such third party service provider. Users and Participants agree not to make any claim or raise any complaint against Beat My Squad in this respect.

Selection and Verification of Winners and Conditions relating to the Prizes

Selection of Winners

Winners will be decided on the basis of the scores of the Teams in a designated match (which may last anywhere between one day and an entire tournament) of the Contest(s). The Participant(s) owning the Team(s) with the highest aggregate score in a particular match shall be declared the Winner(s). In certain pre-specified Contests, Beat My Squad may declare more than one Winner and distribute prizes to such Winners in increasing order of their Team's aggregate score at the end of the designated match of the Contest. The contemplated number of Winners and the prize due to each Winner in such Contest shall be as specified on the Contest page prior to the commencement of the Contest.

Participants creating Teams on behalf of any other Participant or person shall be disqualified. In the event of a tie, the winning Participants shall be declared Winners and the prize shall be equally divided among such Participants. Beat My Squad shall not be liable to pay any prize if it is discovered that the Winner(s) have not abided by these Terms and Conditions, and other rules and regulations in relation to the use of the Beat My Squad, Contest, "Fantasy Rules", etc.

Contacting Winners

Winners shall be contacted by Beat My Squad or the third party conducting the Contest on the e-mail address provided at the time of registration. The verification process and the documents required for the collection of prize shall be detailed to the Winners at this stage. As a general practice, winners will be required to provide following documents:

Photocopy of the User's PAN card; User's bank account copy and proof of the same. Beat My Squad shall not permit a Winner to withdraw his/her prize(s)/accumulated winnings unless the above-mentioned documents have been received and verified within the time-period stipulated by Beat My Squad. The User represents and warrants that the documents provided in the course of the verification process are true copies of the original documents to which they relate.

Participants are required to provide proper and complete details at the time of registration. Beat My Squad shall not be responsible for communications errors, commissions or omissions including those of the Participants due to which the results may not be communicated to the Winner.

The list of contestants may be downloaded in PDF format from Beat My Squad application. The winners will also be intimated by e-mail. In the event that a Participant has been declared a Winner on the above mentioned web-page but has not received any communication from Beat My Squad, such Participant may contact Beat My Squad within the time specified on the webpage.

Verification process

Only those Winners who successfully complete the verification process and provide the required documents within the time limit specified by Beat My Squad shall be permitted to withdraw/receive their accumulated winnings (or any part thereof). Beat My Squad shall not entertain any claims or requests for extension of time for submission of documents.

Beat My Squad shall scrutinize all documents submitted and may, at its sole and absolute discretion, disqualify any Winner from withdrawing his accumulated winnings (or any part thereof) on the following matchs:

Determination by Beat My Squad that any document or information submitted by the Participant is incorrect, misleading, false, fabricated, incomplete or illegible; or Participant does not fulfill the Eligibility Criteria; or Any other match.

Taxes Payable

All prizes shall be subject to deduction of tax ("TDS") as per the Income Tax Act 1961. As of April 1, 2018, the TDS rate prescribed by the Government of India with respect to any prize money amount that is in excess of Rs. 10,000/- is 31.2% of the total prize money amount. In case of any revisions by the Government of India to the aforementioned rate in the future, TDS will be deducted by Beat My Squad in accordance with the then current prescribed TDS rate. Winners will be provided TDS certificates in respect of such tax deductions. The Winners shall be responsible for payment of any other applicable tax, including but not limited to, income tax, gift tax, etc. in respect of the prize money.

Miscellaneous

The decision of Beat My Squad with respect to the awarding of prizes shall be final, binding and non-contestable.

Participants playing the paid formats of the Contest(s) confirm that they are not residents of any of the following Indian states - Assam, Odisha, Sikkim, Nagaland or Telangana. If it is found that a Participant playing the paid formats of the Contest(s) is a resident of any of the abovementioned states, Beat My Squad shall disqualify such Participant and forfeit any prize won by such Participant. Further Beat My Squad may, at its sole and absolute discretion, suspend or terminate such Participant's account with Beat My Squad. Any amount remaining unused in the User's Contest Account or Winnings Account on the date of deactivation or deletion shall be reimbursed to the User by an online transfer to the User's bank account on record with Beat My Squad, subject to the processing fee (if any) applicable on such transfers as set out herein.

If it is found that a Participant playing the paid formats of the Contest(s) is under the age of eighteen (18), Beat My Squad shall be entitled, at its sole and absolute discretion, to disqualify such Participant and forfeit his/her prize. Further, Beat My Squad may, at its sole and absolute discretion, suspend or terminate such Participant's account.

To the extent permitted by law, Beat My Squad makes no representations or warranties as to the quality; suitability or merchantability of any prizes and shall not be liable in respect of the same.

Beat My Squad may, at its sole and absolute discretion, vary or modify the prizes being offered to winners. Participants shall not raise any claim against Beat My Squad or question its right to modify such prizes being offered, prior to closure of the Contest. The Winners shall bear all transaction charges levied for delivery of cash prizes.

Publicity

Acceptance of a prize by the Winner constitutes permission for Beat My Squad, and its affiliates to use the Winner's name, likeness, voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any further permissions or consents and / or additional compensation whatsoever.

The Winners further undertake that they will be available for promotional purposes as planned and desired by Beat My Squad without any charge. The exact dates remain the sole discretion of Beat My Squad. Promotional activities may include but not be limited to press events, internal meetings and ceremonies/functions.

General Conditions

If it comes to the notice of Beat My Squad that any governmental, statutory or regulatory compliances or approvals are required for conducting any Contest(s) or if it comes to the notice of Beat My Squad that conduct of any such Contest(s) is prohibited, then Beat My Squad shall withdraw and / or cancel such Contest(s) without prior notice to any Participants or winners of any Contest(s). Users agree not to make any claim in respect of such cancellation or withdrawal of the Contest or Contest it in any manner.

Employees, directors, affiliates, relatives and family members of Beat My Squad, will not be eligible to participate in any Contest(s).

Dispute and Dispute Resolution

The courts of competent jurisdiction at Durgapur shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Beat My Squad Services provided by Beat My Squad (including the Contest(s)), the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the User(s) (including Participants) or Beat My Squad, as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute referred to arbitration as given below. All such issues and questions shall be governed and construed in accordance with the laws of the Republic of India.

In the event of any legal dispute (which may be a legal issue or question) which may arise, the party raising the dispute shall provide a written notification ("Notification") to the other party. On receipt of Notification, the parties shall first try to resolve the dispute through discussions. In the event that the parties are unable to resolve the dispute within fifteen (15) days of receipt of Notification, the dispute shall be settled by arbitration.

The place of arbitration shall be Durgapur, India. All arbitration proceedings shall be conducted in English and in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.

The arbitration award will be final and binding on the Parties, and each Party will bear its own costs of arbitration and equally share the fees of the arbitrator unless the arbitral tribunal decides otherwise. The arbitrator shall be entitled to pass interim orders and awards, including the orders for specific performance and such orders would be enforceable in competent courts. The arbitrator shall give a reasoned award.

Nothing contained in these Terms and Conditions shall prevent Beat My Squad from seeking and obtaining interim or permanent equitable or injunctive relief, or any other relief available to safeguard Beat My Squad's interest prior to, during or following the filing of arbitration proceedings or pending the execution of a decision or award in connection with any arbitration proceedings from any court having jurisdiction to grant the same. The pursuit of equitable or injunctive relief shall not constitute a waiver on the part of Beat My Squad to pursue any remedy for monetary damages through the arbitration described herein.

Release and Limitations of Liability

Users shall access the Beat My Squad Services provided on Beat My Squad voluntarily and at their own risk. Beat My Squad shall, under no circumstances be held responsible or liable on account of any loss or damage sustained (including but not limited to any accident, injury, death, loss of property) by Users or any other person or entity during the course of access to the Beat My Squad Services (including participation in the Contest(s)) or as a result of acceptance of any prize.

By entering the contests and accessing the Beat My Squad Services provided therein, Users hereby release from and agree to indemnify Beat My Squad, and/ or any of its directors, employees, partners, associates and licensors, from and against all liability, cost, loss or expense arising out their access to the Beat My Squad Services including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission on their part, or otherwise.

Beat My Squad accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself or third parties in relation to the prizes.

Users shall be solely responsible for any consequences which may arise due to their access of Beat My Squad Services by conducting an illegal act or due to non-conformity with these Terms and Conditions and other rules and regulations in relation to Beat My Squad Services, including provision of incorrect address or other personal details. Users also undertake to indemnify Beat My Squad and their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by Beat My Squad on account of such act on the part of the Users.

Users shall indemnify, defend, and hold Beat My Squad harmless from any third party/entity/organization claims arising from or related to such User's engagement with the Beat My Squad or participation in any Contest. In no event shall Beat My Squad be liable to any User for acts or omissions arising out of or related to User's engagement with the Beat My Squad or his/her participation in any Contest(s).

In consideration of Beat My Squad allowing Users to access the Beat My Squad Services, to the maximum extent permitted by law, the Users waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against Beat My Squad, its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the provision of Beat My Squad Services or related to the Contests or the prizes of the Contests.

Disclaimers

To the extent permitted under law, neither Beat My Squad nor its parent/holding company, subsidiaries, affiliates, directors, officers, professional advisors, employees shall be responsible for the deletion, the failure to store, the mis-delivery, or the untimely delivery of any information or material.

To the extent permitted under law, Beat My Squad shall not be responsible for any harm resulting from downloading or accessing any information or material, the quality of servers, contest, products, Beat My Squad services or sites, cancellation of competition and prizes. Beat My Squad disclaims any responsibility for, and if a User pays for access to one of Beat My Squad's Services the User will not be entitled to a refund as a result of, any inaccessibility that is caused by Beat My Squad's maintenance on the servers or the technology that underlies our sites, failures of Beat My Squad's service providers (including telecommunications, hosting, and power providers), computer viruses, natural disasters or other destruction or damage of our facilities, acts of nature, war, civil disturbance, or any other cause beyond our reasonable control. In addition, Beat My Squad does not provide any warranty as to the content on the Beat My Squad(s). Beat My Squad(s) content is distributed on an "as is, as available" basis.

Any material accessed, downloaded or otherwise obtained through Beat My Squad is done at the User's discretion, competence, acceptance and risk, and the User will be solely responsible for any potential damage to User's computer system/mobile devices etc or loss of data that results from a User's download of any such material.

Beat My Squad shall make best endeavors to ensure that the Beat My Squad(s) is error-free and secure, however, neither Beat My Squad nor any of its partners, licensors or associates makes any warranty that: the Beat My Squad(s) will meet Users' requirements, Beat My Squad(s) will be uninterrupted, timely, secure, or error free the results that may be obtained from the use of Beat My Squad(s) will be accurate or reliable; and the quality of any products, Beat My Squad Services, information, or other material that Users purchase or obtain through Beat My Squadcom(s) will meet Users' expectations.

In case Beat My Squad discovers any error, including any error in the determination of Winners or in the transfer of amounts to a User's account, Beat My Squad reserves the right (exercisable at its discretion) to rectify the error in such manner as it deems fit, including through a set-off of the erroneous payment from amounts due to the User or deduction from the User's account of the amount of erroneous payment. In case of exercise of remedies in accordance with this clause, Beat My Squad agrees to notify the User of the error and of the exercise of the remedy (ies) to rectify the same.

To the extent permitted under law, neither Beat My Squad nor its partners, licensors or associates shall be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use our sites, even if we have been advised of the possibility of such damages.

Any Beat My Squad Services, events or Contest(s) being hosted or provided, or intended to be hosted on Beat My Squad platform and requiring specific permission or authority from any statutory authority or any state or the central government, or the board of directors shall be deemed cancelled or terminated, if such permission or authority is either not obtained or denied either before or after the availability of the relevant Beat My Squad Services, events or Contest(s) are hosted or provided.

To the extent permitted under law, in the event of suspension or closure of any Services, events or Contests, Users (including Participants) shall not be entitled to make any demands, claims, on any nature whatsoever.

Miscellaneous

Beat My Squad may be required under certain legislations, to notify User(s) of certain events. User(s) hereby acknowledge and consent that such notices will be effective upon Beat My Squad posting them on the Beat My Squad or delivering them to the User through the email address provided by the User at the time of registration. User(s) may update their email address by logging into their account on the Beat My Squad. If they do not provide Beat My Squad with accurate information, Beat My Squad cannot be held liable for failure to notify the User.

Beat My Squad shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to any failure to perform due to unforeseen circumstances or cause beyond Beat My Squad's control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor or materials or any cancellation of any cricket match to which a Contest relates. In such circumstances, Beat My Squad shall also be entitled to cancel any related Contest(s) and to process an appropriate refund for all Participants.

Beat My Squad's failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

Users agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Beat My Squad or these Terms must be filed within thirty (30) days of such claim or cause of action arising or be forever barred.

These Terms and Conditions, including all terms, conditions, and policies that are incorporated herein by reference, constitute the entire agreement between the User(s) and Beat My Squad Fantasy Sports LLP and govern your use of the Beat My Squad, superseding any prior agreements that any User may have with Beat My Squad Fantasy Sports LLP.

If any part of these Terms and Conditions is determined to be indefinite, invalid, or otherwise unenforceable, the rest of these Terms and Conditions shall continue in full force.

Beat My Squad reserves the right to moderate, restrict or ban the use of the Beat My Squad, specifically to any User, or generally, in accordance with Beat My Squad's policy/policies from time to time, at its sole and absolute discretion and without any notice.

Beat My Squad may, at its sole and absolute discretion, permanently close or temporarily suspend any Beat My Squad Services (including any Contest(s)).

Beat My Squad may from time to time conduct/organize promotions/offers on the platform. Any two or more promotions cannot be clubbed together with any other promotions that are running simultaneously on the Beat My Squad platform. Also, promotions/offers cannot be clubbed with Cash Bonus available with any user.

Standard Terms and Conditions of Promotions

These standard terms and conditions of promotions (“Standard Terms”) supplement the terms of promotions undertaken on the Beat My Squad website and which reference these Standard Terms (each a “Promotion”):

Participation in any Promotion will be subject to a user complying with the Promotion Terms implemented by Beat My Squad in respect of such Promotion (“Promotion Terms”) and these Standard Terms. By participating in any Promotion, the participant further consents to and agrees to adhere with the terms and conditions of the Beat My Squad contest and Beat My Squad’s privacy policy.

The Promotions are only open to users in India. Participation in the Promotions by proxy is not permitted.

Participation in the Promotions is voluntary.

Participation in one Promotion does not guarantee that such user will be eligible to participate in another Promotion.

A user may participate in a Promotion and avail of each Promotion only through one account. An existing user of Beat My Squad shall not register a new account or operate more than one user account with Beat My Squad or participate in a Promotion by registering a new account.

Users intending to participate in a Promotion may be required to verify their mobile number and other account details in accordance with the Promotion Terms for such Promotion.

Persons intending to participate in a Promotion, who have listed their phone numbers on the National Do Not Call Registry (“NDNC Registry”), shall de-register themselves from the NDNC Registry till the completion of such Promotion (including the delivery of Bonus Amount (if any) or the free-entry (if any) under such Promotion). Such persons agree not to make any claim or raise any complaint whatsoever against Beat My Squad in this respect. Please note that persons intending to participate in a Promotion who have not de-registered themselves from the NDNC Registry shall also have no right to make any claim or raise any complaints against Beat My Squad if they do or do not receive any call or SMS with respect to their participation and all other matters pertaining to a Promotion.
The verification process may require you to submit personal information about yourself. You agree to receive communication from Beat My Squad. Any information collected in respect of your identity and contact details as part of a Promotion or otherwise in the course of your use of the Beat My Squad Website shall be subject to Beat My Squad’s Privacy Policy.

Beat My Squad may, at its sole and absolute discretion, disqualify any user from a Promotion if such user engages in or it is found that such user has engaged in any illegal, unlawful or improper conduct (with regard to any of the Promotions or otherwise).

The Bonus Amount (if any) deposited into the user’s account can be used to join cash contests and contests on Beat My Squad. However, the Bonus Amount (if any) cannot be: withdrawn or transferred to any other cash balance account held by you with Beat My Squad or to any third party account or to any bank/payment instrument account

The deposit of the Bonus Amount (if applicable) or the grant of the free-entry (if any) shall be at the sole discretion of Beat My Squad and shall be subject to the user’s compliance with these Standard Terms and the applicable Promotion Terms. Beat My Squad may substitute or change the Bonus Amount(if any) or free-entry (if any) offered under a Promotion at any time without notice. Users may not substitute Bonus Amount (if any) or free-entry (if any) for other items or exchange for cash.

Beat My Squad reserves the right to withhold or forfeit the benefits of a Promotion (including a free-entry or Bonus Amount due to a participant or any prizes/winnings earned by the participant by using such benefits) in the event that it determines or reasonably believes that the participating user has violated these Standard Terms, the applicable Promotion Terms or the terms and conditions of the Beat My Squad fantasy contest(s).

Mere participation in a Promotion does not entitle the participant to receive any free-entry or Bonus Amount(s) indicated as a prize under such Promotion.
The decision of Beat My Squad will be final and binding with respect to the Promotions, and the prizes therein and no correspondence, objection, complaints, etc. will be entertained in this regard.

Each Promotion cannot be clubbed with any of other contest/offer/promotion that are running simultaneously and organised or conducted by Beat My Squad.

Beat My Squad reserves the right to change/modify/or withdraw any of the Promotions and/or change these Standard Terms and/or the Promotion Terms without any prior notice of the same at its sole discretion.

Beat My Squad does not make any commitment, express or implied, to respond to any feedback, suggestion and, or, queries of the participants of the Promotions. Notwithstanding anything contained herein, the aggregate liability of Beat My Squad to a participating user in relation to any Promotion for any reason whatsoever shall not exceed Rs. 25.

The Promotions shall be governed by the laws of the Republic of India, and any disputes or disagreements in respect of this Promotion shall be subject to the exclusive jurisdiction of the courts of Durgapur.

1.       Standard Terms and Conditions of "Invite Friends" program.

The Beat My Squad Invite Friends Program lets you invite friends to join Beat My Squad ("Program"). In the event that you and your referred friend meet the criteria and complete all the steps specified in these terms, you and your friend can earn a Cash Bonus from Beat My Squad of upto Rs. 101 ("Bonus Amount"), which Bonus Amount will be redeemable to join cash contests and contests through the Beat My Squad’s mobile application("Beat My Squad Application"). To participate in the Program, please note our terms and conditions ("Terms") in this respect, as they govern your participation in the Program:

Eligibility – All users who: (i) have an account registered with Beat My Squad's fantasy gaming platform ("Platform") which account has been verified by Beat My Squad; and (ii) are eligible to participate in the pay-to play Beat My Squad fantasy cricket, (as per the Beat My Squad's terms and conditions, accessible at https://fantasycricket.Beat My Squad.com/in/termsandconditions); and (iii) have downloaded and installed the Beat My Squad Application on their respective mobile devices, will be eligible to participate in the Program. Participation in the Program by proxy is not permitted.

Participation in the Program is voluntary. A user shall not register or operate more than one user account with Beat My Squad and shall not participate in the Program with more than one user account with Beat My Squad.

By participating in the Program, you agree to and accept these Terms.

For the purpose of participation in the Program, you are required to have the Beat My Squad Application downloaded and installed on your mobile device. Through the Beat My Squad Application, you will be provided with a unique link or code, which can be shared by you ("Inviter") with friends (each an "Invitee") for the purpose of inviting such friends to create and register an account with Beat My Squad and download the Beat My Squad Application. On receiving the link or code from the Inviter, the Invitee may either: (i) Click on the link, consequent to which such Invitee will be directed to a registration page and will be provided the option to register an account with Beat My Squad and download and install the Beat My Squad Application on his/her device; or (ii) download and install the Beat My Squad Application on his/her device independently, register for a Beat My Squad account through the Beat My Squad Application and enter the unique code shared by the Inviter where prompted in the Beat My Squad Application.

The Inviter and the Invitee will be eligible to earn the Bonus Amount subject to (amongst other terms specified in these Terms): (i) the Invitee not being an existing user of Beat My Squad; and (ii) the Inviter and Invitee being eligible to participate in the pay-to play Beat My Squad fantasy cricket; and (iii) the Invitee successfully registering for an account with Beat My Squad through the unique link or by using the unique code shared by the Inviter; and (iv) the Inviter and Invitee agreeing to the license agreement for the Beat My Squad Application and downloading and installing the Beat My Squad Application as available for the Inviter’s and Invitee’s respective mobile devices; and (v) the Inviter and Invitee verifying the Inviter’s and the Invitee’s respective mobile number as provided at the time of registration within thirty (30) days from the date on which Invitee registers for an account with Beat My Squad ("Verification Period"). For the purposes of these Terms, an 'existing user of Beat My Squad' shall mean a user who presently operates an account with the Platform or operated an account with the Platform at any point of time.

An Invitee who is an existing user of Beat My Squad is not permitted to register a new account with the Platform for the purpose of availing of the Bonus Amount. Beat My Squad will determine in its sole discretion whether an Invitee is an existing user of Beat My Squad or not and take appropriate action.

The verification process may require an Inviter/Invitee to submit personal information about the user (Inviter/Invitee) and documents identifying the Inviter/Invitee. The Inviter agrees to receive communication from Beat My Squad and to allow Beat My Squad to communicate with Invitees referred by you about the Inviter's participation in the Program. Any information collected in respect of the Inviter/Invitee as part of the Program or otherwise in the course of such person's use of the Website shall be subject to Beat My Squad's Privacy Policy (available here: https://fantasycricket.Beat My Squad.com/in/privacypolicy for Indian users)

The verification of an Inviter/Invitee shall be completed at the time of first withdrawal by the Inviter/Invitee from the Inviter’s/Invitee's 'Your Winnings' account or 'Your Deposits' account with the Platform. An Inviter/Invitee may voluntarily seek verification of the Inviter/Invitee by clicking on the 'Verify Now' tab of the Account Balance page of the Inviter/Invitee's account with the Platform. In the event that the Invitee opts to register for a Beat My Squad account through the Beat My Squad Application, the Invitee can verify his/her contact information at the time of registration.

The Invitee will be eligible to earn a Bonus of Rs.51 (“Invitee Bonus”) upon a) successful verification of the Invitee’s mobile number. b) Provided that the Invitee completes the step mentioned in a) above within the Verification Period, the applicable Invitee Bonus shall be credited to the Invitee's Cash Bonus Account with the Platform, within fifteen (15) days of completion of successful verification of the Invitee’s mobile number. In the event that the Invitee fails to verify the Invitee's mobile number within the Verification Period or omits to provide documents requested for such verification, the Invitee shall not receive the applicable Invitee Bonus specified above due to the Invitee for completing such verification process.

Inviter Bonus

a) In order for an Inviter to be eligible to earn the Bonus Amount due to him/her ("Inviter Bonus"), the Inviter must also download and install the Beat My Squad Application on his/her mobile device verify his/her mobile number and email address prior to the completion of the Verification Period.

b) The credit of the Inviter Bonus is contingent on the Invitee's participation in cash contests on the Platform. For every Rs. 1 spent by the Invitee to join cash contests on the Platform, the Inviter will be eligible to earn a bonus amount of Rs. 0.10 subject to a maximum of Rs. 50/-. As an example, in the event that the invitee uses Rs. 50 from his Cash Bonus Account or Unutilized Account to join a cash contest or contest through Beat My Squad Application, the Inviter shall be eligible to receive Rs. 5/- as Inviter Bonus upon the successful completion of such contest or contest, provided that the Inviter has successfully completed the requisite steps detailed in a) above that make him/her eligible to receive such amount.

c) Subject to the provisions of a) and b) above, the applicable Inviter Bonus earned by the Inviter shall be credited to the Inviter's Cash Bonus Account within fifteen (15) days of the completion of the cash contest or contest in which Invitee has used the Invitee Bonus or within fifteen (15) days of the Inviter completing the relevant step verification process, as the case may be. In the event that the Inviter fails to complete any of the verification steps within the Verification Period or omits to provide documents requested for such verification, the Inviter shall not be eligible to earn the applicable Inviter Bonus.

d) It is clarified that the Inviter will be eligible to receive the Inviter Bonus with respect to any contests or contests only in the event the winners are declared for such contests or contests only. In the event that the contest entry amount paid by the Invitee is refunded to the Invitee with respect to any cash contest or contest, for any reason, the Inviter shall not be eligible to receive any Inviter Bonus for such contest or contest.

The Bonus Amounts credited to the Inviter/Invitee can be used by the Inviter/Invitee to join cash contests and contests offered by Beat My Squad through the Platform. No part of the Bonus Amount may be used to join private contests or be withdrawn or transferred to any other cash balance account held by the Inviter/Invitee with Beat My Squad or to any third party account or to any bank/payment instrument account. THE BONUS AMOUNT HAS NO EXPIRY.

The deposit of the Bonus Amount shall be at the sole discretion of Beat My Squad and shall be subject to the Inviter’s/Invitee’s compliance with these Terms. Beat My Squad may substitute or change the Bonus Amount offered under the Program at any time without notice. An Inviter/Invitee may not substitute the amount of Bonus Amount or substitute offering for other items or exchange for cash.

Beat My Squad reserves the right to: withhold the deposit of the Bonus Amount; and/or forfeit any deposited Bonus Amount to an Inviter/Invitee or any prizes/winnings earned by the participant by using such Bonus Amount; and/or deactivate the accounts of the Inviter/Invitee, in the event that it determines or reasonably believes that such Inviter/Invitee has violated these Terms or the terms and conditions of the Beat My Squad fantasy contest. Mere participation in the Program does not entitle the Inviter/Invitee to receive any Bonus Amount.

Beat My Squad may, at its sole and absolute discretion, disqualify any Inviter/Invitee if such Inviter/Invitee engages in or it is found that such Inviter/Invitee has engaged in any illegal, unlawful or improper conduct (with regard to the Program or otherwise). The decision of Beat My Squad will be final and binding with regard to the Program, and the deposit of the Bonus Amount and no correspondence, objection, complaints, etc. will be entertained in this regard.

Notwithstanding anything contained herein, the aggregate liability of Beat My Squad to a participating Inviter/Invitee in relation to the Program for any reason whatsoever shall not exceed Rs.50.

Refund Policy

All deposits made and fees paid on Beat My Squad.com to play Fantasy Cricket games or in connection with Fantasy Cricket are final. All transactions on Beat My Squad are final. Customer satisfaction is extremely important to us, so only error-oriented transaction cases shall be reviewed.

If you are not fully satisfied with any deposit made or fee paid and feel there is an 'Error’ in the transaction, please let us know about that within 3 days of the transaction date—we shall certainly review the transaction and determine the resolution, if necessary, at our discretion.

Beat My Squad reserves the right to cancel any matches for any reason, with or without disclosure of the reason, and refund all fees paid for such matches by any to all Users.
